This Privacy Policy describes what information Kinowelt Television GmbH (“Kinowelt” or “us”) collects about its customers, suppliers, production participants, candidates, or, in general, collaborators, current, past or potential that in any way are involved in the corporate or business activity of Kinowelt, and why, how we use and share that information, and the choices we offer (the “Policy”). This Policy will not apply to personal data of users of web pages, applications, services, contests or promotions of Kinowelt that have a specific policy.

This Privacy Policy describes what information Kinowelt Television GmbH (“Kinowelt” or “us”) collects about the person involved and why, how we use and share that information, and the choices we offer (the “Policy”).
This Policy will apply to all personal data we collect: (i) by virtue of a contractual or pre-contractual relationship with suppliers, customers or other collaborators (ii) other individuals in connection to the activity of Kinowelt, including journalists, institutional contacts, participants in activities, productions or events under Kinowelt´s control (iii) individuals interested in working with us (jointly, the “Collaborators”). This Policy will not apply to personal data that we collect of users of our services, web pages, applications, contests or promotions. This Policy will apply regardless of the way or support used to obtain the data.

WHAT PERSONAL DATA DO YOU COLLECT?
Except with the express authorization of the parents or legal representatives, Kinowelt does not collect information from minors under 16 (sixteen) years old. Therefore, either we require that all the Collaborators are at least of that age, or we enable the verification mechanism of the authorization of their parents or appropriate legal representatives. If we find out that a Collaborator is less than 16 (sixteen) years old and we are not certain that we have obtained valid authorization from their parents or legal representatives, we will immediately eliminate all the information associated with such Collaborator. This will be without prejudice to other capacity requirements (e.g.: legal age) for establishing the concrete relationship.
As for Collaborators older than 16 (sixteen) years old, or those under such age of that age duly authorized by their parents or legal representatives, their information may come from different ways:
INFORMATION PROVIDED BY THE COLLABORATOR: Throughout the duration of the relationship between the Collaborator and Kinowelt, including preparatory or posterior activities, the Collaborator may be asked for, or can spontaneously provide, personal data, such as name, email, telephone number, mail address, job position work or academic details (CV), bank account, identification number, picture, etc. If it is mandatory to provide certain information, it will be expressly designated as such. Also, while our relationship lasts, we will collect any other information that the Collaborator may provide; in particular, if the Collaborator sends us an email, we will collect email address and the full content of the message, including attachments and any other information. Likewise, we may process the information resulting from Collaborator visit to our offices or facilities, or to events or activities organized under our responsibility, either through access records or security video surveillance systems. Additionally, we may collect publicly available Collaborator´s information that may be of our interest.
INFORMATION WE COLLECT AUTOMATICALLY FROM YOUR DEVICES: In the event that the Collaborators access with devices of their property to any applications or services of Kinowelt, including use of the Wi-Fi network in our offices, we may collect information such as the hardware model, the operating system and the version, the IP address and the MAC identifier or other unique device identifiers, mobile network information and information the interaction of the device with our services.
THIRD PARTIES INFORMATION: We may obtain Collaborators´ information through other sources that Collaborator could give us permission to access through; specifically, services provided but third parties, including platforms or specialized entities in search of employment or social networks. The personal information we obtain from those sources will depend on the privacy settings of the Collaborator on those services, its options and the privacy policies of those third parties. Therefore, we recommend the Collaborators check these policies and determine the privacy settings according to their preferences. In case of combining or associating information from other sources with the information given by the Collaborator, we will process the combined information as personal data, in accordance with the provisions of this Policy.
AGGREGATE AND/OR ANONYMOUS INFORMATION: We may aggregate or anonymize certain information that we collect from the Collaborator, so we cannot identify him personally.
FOR WHAT WILL MY INFORMATION BE USED?
The information concerning the Collaborator may be used by Kinowelt for the following purposes:
Management of the concrete relationship with Kinowelt or other purpose for which the Collaborator has provided them: processing or collecting payments, communication actions, notifications and contacts, evaluation of candidacies, management of participation in productions or events;
- Access of the Collaborator to services, products, events or activities of Kinowelt, present or futures;
- Submission of communications (informative or business, without commercial nature) about the activities, products or services of Kinowelt involved in the concrete relation with the Collaborator;
- Maintenance, development and improvement of the products and services of Kinowelt, including statistical analysis;
- In case the Collaborator had expressly given consent, for sending information, opportunities, promotions and additional functions by mail and telephone, and email, text messages or other electronic means, either directly or on our behalf, or through our partners or advertisers in the following sectors: fashion, jewelry, entertainment industry, cinema and audiovisual arts, food and gastronomy, beauty and personal care, energy industry, goods and consumer industry, electronics and telecommunications, nightlife, family and Community, astrology and occult sciences, nutrition and diet, leisure and hobbies, home and garden, training and employment, media and publications, sports and fitness, tourism and travel, vehicles, unusual phenomena, curiosities.
WHY DO YOU PROCESS MY INFORMATION?
The main reason for the processing of the Collaborators information is the correct maintenance of the past, current or potential relationship with Kinowelt. Likewise, Kinowelt has a legitimate prevailing interest for carrying out actions or achieving purposes that are not incompatible with those for which the data was first collected. In addition, sometimes, the processing or conservation of the data will be necessary for the fulfillment of our legal obligations. Such data are strictly necessary, adequate and pertinent for this purpose.
TO WHOM IS MY INFORMATION IS COMMUNICATED? EVEN OUTSIDE THE EUROPEAN UNION?
Except in the circumstances described below, we will not disclose Collaborator information to third parties.
WITH THE CONSENT OF THE COLABORATOR: we can share or disclose Collaborators´information whenever they ask for it or authorize us for it. In particular, with Collaborators’ consent, we can transfer the information to our partners or advertisers in order to send them the commercial communications point 3 e) refers to.
AMONG GROUP COMPANIES: We may share Collaborator’s information with our affiliated and joint venture partners companies belonging to the media and entertainment, and/or data research industries, for the purposes of processing, analyzing or storing the Collaborators´ information, in each case, always in accordance with the terms of this Policy.
TO OUR TRUSTES THIRD PARTY SERVICE PROVIDERS: We engage third party service providers to perform a variety of services and functions for us. We may share the Collaborator’s information with such service providers subject to confidentiality obligations consistent with this Policy and on the condition that the third parties use your information only on our behalf and pursuant to our instructions.
TO COMPLY WITH LEGAL REQUIREMENTS AND TO PROTECT THE COLLABORATOR, US AND OTHERS: Notwithstanding anything in contrary in this Policy, we reserve the right to retain and disclose the Collaborators’ information if we believe, in good faith, that such retention and disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas, warrants or similar process served on us; (b) protect and defend our rights or property, the Collaborators, or third parties; or (c) ensure the safety and security of our services, systems and of our customers and third parties.
IN CONNECTION WITH A BUSINESS TRANSFER: in the event we go through a business transition such as a merger, acquisition by another company, reorganization or sale of all or a portion of our assets, the Collaborators’ information may be transferred as part of that transaction in accordance with applicable data protection regulation.
IF THE INFORMATION HAS BEEN ANONYMIZED: We may share or disclose information that has been anonymized, otherwise does not identify the Collaborator or information that the Collaborator choose to make public. This Policy does not limit our use or disclosure of anonymous information in any way, and we reserve the right to use and disclose such information to third parties.
INTERNATIONAL TRANFERS: The information we collect from the Collaborator may be transferred to countries that are currently regarded as countries which do not provide a level of protection of personal data that may be equivalent to the one afforded under the relevant European Union data protection laws and regulations (in particular, the United States). To carry out this transfer, the appropriate legal guarantees have been adopted so that the Collaborator has enforceable rights and effective legal actions, specifically model clauses. The Collaborator can obtain more information about this by contacting the Data Protection Officer.
WHAT ARE MY CHOICES? HOW CAN I EXERCISE MY RIGHTS?
EXERCISE OF RIGHTS: If applicable in accordance with the applicable regulations, the Collaborators may exercise their rights as provided in this Policy and in the terms established by such regulations. In such condition, the Collaborators may:
- Access the information we process, and that personally identifies them;
- Request rectification or deletion of incorrect or inaccurate data;
- Request deletion of personal data when, among other reasons are no longer necessary for the purposes for which they are collected;
- Require the limitation of data use in certain circumstances (for instance, in case the Collaborator challenges the accuracy of their data, while verifying the accuracy thereof);
- Request portability of their information (that is, to receive personal data in a structured format, commonly used and mechanically read, and transmit them to another data controller in accordance with the applicable legislation);
- Oppose the processing of his personal data, at any time, for reasons related to his particular situation, in case the processing is based on the legitimate interest of Kinowelt or a third party. In this case, Kinowelt will stop that processing, except for accreditation of legitimate reasons to continue with it;
- Revoke the consent given, as the case may be;
- Submit a claim to the supervisory authority, especially when he has not obtained satisfaction in the exercise of his right.
The Collaborators may exercise their rights, subject to prior accreditation of their identity by providing copy of commonly accepted identifying document, by contacting Kinowelt by: (i) email at privacy-ce@amcnetworks.com or at dpo@amcnetworks.com, or (ii) post to the following address: Kinowelt Data Protection – Germany, Hohenstaufenring 43-45, 50674 Köln. In the maximum term of 30 (thirty) days, the Collaborator will have a response to such request.
COMMERCIAL COMMUNICATIONS: If the Collaborators have given consent for the receipt of commercial communications, at any time they may revoke it. When the Collaborators receive promotional communications, they may indicate a preference to stop receiving further promotional communications from us, and will have the opportunity to “opt-out” by following the unsubscribe instructions provided on the commercial email received or by contacting us directly at privacy-ce@amcnetworks.com or at dpo@amcnetworks.com. Despite the Collaborators indicated e-mail marketing preferences, we may still send them non-marketing emails related to their relationship with us, including, for example, administrative confirmations and notices of updates to our Policy, if we choose to provide such notices to the Collaborators in this manner.
HOW LONG DO YOU KEEP MY INFORMATION?
We will hold the Collaborators information as long as the specific relationship of collaboration is maintained, as described, and, once it is finalized, or when the right of withdrawal has been exercised, as long as required by applicable legislation or regulations.
OTHER QUESTIONS
CHANGES IN POLICY. We may change this Policy for time to time. If we make changes, we will notify the Collaborator by posting the updated policy and revising the “Effective Date” above. If we make any material changes to this Policy, we will also notify the Collaborator. We encourage the Collaborator to review the Policy to stay informed about our information practices and the choices available.
SECURITY MEASURES: We are committed to protecting the security of Collaborators´ information. We use a variety of industry-standard security technologies and procedures to help protect the Collaborators´ information from unauthorized access, use or disclose. These measures are compliant with the requirements under the law, vary based on the sensitivity of the information that we collect and they are updated as technology advances.
OTHER JURISDICTIONS: It is the Collaborators who decide to establish a relationship with Kinowelt by their own will and therefore they are responsible for compliance with local legislation, as long as and to the extent that it is applicable.
